  • After reading Mapp v. Ohio (1961) [Book 2], explain the following: (a) what constitutional amendment is being discussed in the case, and what right (s) does it cover? (b) What did the decision of the Supreme Court of the United States in this case and why? (c) The Court must balance the protection of the rights of individuals against the welfare of society. If the police had not searched Mapp’s house, they would never have found the obscene material. With this in mind, do you think Mapp’s rights or society should have been more critical? Explain
  • After reading about Hudson v. Michigan (2006), Herring v. United States (2009) and Davis v. The United States (2011) [Book 1], answer the following: Several scholars have suggested that following Hudson, Herring and Davis, the police have little to lose and much to gain by violating the rights of Fourth Amendment suspects. Assuming that these scholars are correct, what are the possible costs and benefits of this new reality? Again, thinking that this is true, how could this new fact influence the criminal justice system and crime?
